This Privacy Notice and Policy (“Policy”) describes how Danielle Kubik (or “Danielle Kubik Photography,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information, and explains the choices you have. Your use of our Services (defined below) is subject to this Policy and any additional terms presented to you.

1) Scope


This Policy applies to personal information we process in connection with:

Our photography services and related offerings, including inquiries, bookings, contracts, payments, sessions, galleries, image delivery, and customer support (collectively, the “Services”);


Our offline interactions (e.g., at sessions or events).


This Policy does not apply to information about our independent contractors (if any) collected in a non-consumer capacity.


2) Personal Information We Collect

a) Information You Provide Directly


The information we collect depends on how you interact with us, and may include:


Contact & account information: name, email address, phone number, mailing address, city/state, preferred contact method.


No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.


Booking & session details: date, location, names of participants, preferences, shot lists, notes, model releases/consents, and any special instructions (e.g., accessibility needs).


Galleries & deliverables: selections, feedback, print orders, and download history.


Payments & purchases: payment method details processed by our payment processors (we do not store full card numbers), billing address, and transaction records.


Communications: inquiries, emails, texts, responses to questionnaires, and support requests; comments on our social media pages.


Promotions & surveys: information submitted for giveaways, promotions, testimonials, or surveys (optional).


b) Information from Other Sources


Referrals & event partners: event planners, venues, or clients may share your contact/session details to coordinate Services (e.g., wedding timelines).


Social media platforms: posts, messages, tags, or interactions you direct to us (platforms control what they share; see their privacy policies).


c) Information Collected Automatically


When you use the Site, we (and our service providers) may automatically collect:


Device & usage data: IP address, general location (derived from IP), browser type, device identifiers, pages viewed, referring/exit pages, time on site, and clickstream.


Cookies, pixels, and similar tools: to operate the Site, maintain security, measure performance, and understand engagement. See Section 6.


3) How We Use Personal Information


We use personal information to:


Provide Services: respond to inquiries, send quotes, draft and manage contracts, schedule and conduct sessions, deliver galleries/products, process payments, and provide support.


Operate, analyze, and improve: maintain the Site; troubleshoot; analyze usage; develop new features and offerings; quality control and training.


Personalize: tailor communications, proposals, galleries, and recommendations.


Marketing & communications: send newsletters, promotions, updates, and session announcements (you can opt out).


Portfolio & business development: with your consent or as permitted by contract/law, display selected images in portfolios, on the Site, social media, studio samples, submissions for publication, or competitions. You can manage preferences (see Section 7).


Security & fraud prevention: protect rights, prevent misuse, and enforce terms.


Legal & compliance: comply with laws, respond to legal requests, and maintain records.


Business operations: bookkeeping, accounting, and general administration.


4) How We Disclose Personal Information


We may disclose personal information:


Service providers / processors: website hosting, gallery/portfolio platforms, client management and contract tools, scheduling tools, payment processors, email/SMS providers, analytics, printing labs, couriers, and IT/security vendors. These parties may only use data on our behalf.


Event- or session-related partners: with your knowledge, we may share limited details with venues, planners, stylists, or second shooters needed to perform the Services.


Legal and safety: to comply with law, respond to lawful requests, protect rights/safety, and prevent fraud or abuse.


Business transfers: in a merger, sale, or similar event, your information may be transferred as part of the transaction.


We do not sell personal information for money. See Section 12 for California “sale”/“sharing” definitions related to targeted advertising.


5) Images, Minors, and Consents


Model releases & usage: We may request a model release/consent to use images for portfolio, marketing, or publication. You can grant or withhold consent; choices may be part of your contract or intake form.


Minors: We require a parent or legal guardian to approve and, where applicable, sign releases for participants under 18.


Sensitive locations/events: For sessions involving private locations, sensitive events, or safety concerns, we will honor written restrictions you specify in your contract or request form.


6) Cookies, Targeting, and Analytics


We and our service providers use cookies, pixels, and similar technologies to:


Operate the Site and keep it secure;


Measure performance and analytics (e.g., which pages are visited);


Improve and personalize the Site and communications;


Support marketing on and off the Site (where permitted).


Your choices:


Browser settings: you can block or delete cookies via your browser; some features may not work without essential cookies.


Platform controls: analytics/ads platforms provide their own settings.


Global Privacy Control (GPC): if your browser sends a GPC signal, we will treat it as a request to limit certain cookie-based tracking for that browser where feasible.


7) Your Privacy Choices


Marketing emails/texts: unsubscribe via the link in our emails or reply STOP to texts.


Portfolio/image use: you can state or change your image-use preferences (where allowed by contract/law) by emailing us at daniellekubikphotography@gmail.com

Cookies/ads: manage via browser/device settings and available platform tools.


Access, correction, or deletion requests: see Section 12 for California rights; others may contact us at the email below and we will consider requests consistent with applicable law.


8) Children/Minors Online


The Site is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If we learn that we have collected such information contrary to law, we will delete it. Parents/guardians may contact us to request deletion.


9) Security


We use reasonable administrative, technical, and physical measures designed to protect personal information. No method of transmission or storage is 100% secure.


10) Retention


We keep personal information for as long as reasonably necessary for the purposes described in this Policy, to perform our contracts, comply with legal obligations (e.g., tax/accounting), resolve disputes, protect our rights, and maintain business records. Retention periods for images may be specified in your contract.


11) Changes to This Policy


We may update this Policy from time to time. The “Effective Date” above reflects the latest version. We will post updates on this page and, if changes are material, we will provide additional notice as required by law.


12) California Privacy Notice (CCPA/CPRA)


Scope. This section applies only to California residents and describes how we collect, use, disclose, “sell,” and “share” personal information and the rights you may have under the California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, “CCPA”).


Categories of Personal Information We May Collect


Identifiers: name, contact information, IP address, device identifiers.


Customer records & commercial information: bookings, contracts, purchases, transaction history.


Internet/Network activity: browsing data, interactions with the Site.


Audio/visual: photographs and session deliverables, as applicable.


Inferences: preferences derived from interactions (e.g., style choices).


Sensitive personal information is not sought in the ordinary course; if collected (e.g., for identity verification), we use/disclose it only as permitted by CCPA §7027.


Sources


Directly from you; your devices/browser; event partners; service providers; and publicly available sources (e.g., social media interactions you direct to us).

See Section 4 above. We disclose personal information to service providers/processors for business purposes.


“Sales” and “Sharing”


We do not exchange personal information for money. Like many small businesses, we may “share” (as defined by the CCPA) certain online identifiers and usage data with advertising/analytics partners via cookies/pixels for cross-context behavioral advertising. You can opt out of such sharing by using browser controls, GPC signals, or contacting us.


Your CCPA Rights


Subject to legal limits, California residents may request to:


Know/Access: the categories and specific pieces of personal information we collected about you;


Delete: personal information we collected from you;


Correct: inaccurate personal information;


Opt-out of “selling”/“sharing”: as described above;


Limit use of sensitive personal information: we do not use sensitive personal information beyond permitted purposes;


Non-discrimination: you will not be discriminated against for exercising your rights.

with your request (Know/Access, Delete, Correct, Opt-Out). We will verify your identity using information you provide and what we maintain. An authorized agent may submit a request with proof of authorization; we may also require you to verify directly.


GPC: If we detect a valid Global Privacy Control signal, we treat it as a request to opt out of cookie-based “sharing” for that browser.
